EULA FAQs

1. Our legal team would like to request changes to your EULA. Can that be done?

At this time, Agile Pulse is unable to make individual changes to our standard EULA under our current pricing model.
Because we offer our products at cost‑effective, scalable pricing, negotiating and maintaining custom agreements for each customer would create significant administrative overhead and increase costs for all users.

Our standard EULA has been carefully drafted to be fair and balanced for both our customers and Agile Pulse, allowing us to focus our resources on product quality, support, and compliance obligations.

2. Your EULA includes a grant of Publicity Rights. What does that mean, and can we opt out?

Agile Pulse occasionally features a limited selection of customers on our website and in materials as examples of organizations using our products.

If you prefer not to be mentioned or listed as a customer for any form of publicity, simply submit a request to legal@agilepulse.co
Once received, we will add your company to our opt‑out list to ensure you are excluded from future customer listings or promotional references, including on our website.

3. Your EULA mentions data collection and storage. Can you clarify what data is involved?

Agile Pulse only maintains limited customer data within our internal systems, such as:

  • Customer and transaction information (e.g., account details and purchase history)

  • Any information you choose to provide via our support portal, online knowledge base, or related communication channels

Application‑level data is managed as follows:

  • For Atlassian Cloud products (built on Atlassian’s “Connect” architecture), data is stored within Atlassian’s cloud infrastructure, and storage locations may vary by product.

  • Agile Pulse does not maintain application‑level data on our own systems for these cloud applications.

    Agile Pulse is designed to minimize data handling and relies primarily on Atlassian Jira for storing end‑user data.

    • All Jira content, including ticket descriptions, comments, and attachments, remains in your Atlassian Cloud environment.
    • Agile Pulse does not store this content in our systems / subprocessors.
    • Agile Pulse stores only minimal metadata in our secure environment to enable integration functionality such as but not limited to:
      • Jira Ticket ID
      • Jira Board ID
      • Jira User ID
    • This metadata does not include any end‑user sensitive information and is used solely to maintain session state and integration performance.

    We emphasize that Agile Pulse does not process or retain Jira content; sensitive data stays with Atlassian.

To protect customer privacy and maintain security, we do not disclose specific storage locations for each individual product.

4. Your EULA mentions open‑source libraries. Which ones are used?
Agile Pulse applications utilize open‑source components where appropriate.
For a list of the specific libraries used in a particular Product, please contact the Product Support team listed on our Contact page.

5. Can our affiliate users also use the add‑ons under your EULA?
Yes – provided that:

  1. Your affiliate users are counted as part of your total “Authorized Users,” as defined in the Orders section of the EULA, and

  2. Their use remains within your agreed Scope of Use.

6. Do you have a data security policy?
Yes. Agile Pulse’s Data Security and Privacy practices are detailed in Section 10 of our EULA, which applies to all customers and products.

GDPR FAQs

1. I use Agile Pulse Atlassian apps – does GDPR apply to me?

An Atlassian customer is any organization that holds an active license for Atlassian software.

  • If you administer Atlassian software at your company and process or control personal data of EU residents, GDPR requirements apply to your organization. We recommend reviewing the EU GDPR regulations to understand your responsibilities.

  • If your organization does not process or control personal data of EU citizens (for example, operations limited to the U.S. or Asia‑Pacific regions), then GDPR is unlikely to apply to you.

2. As an Atlassian customer, am I considered a Data Controller under GDPR?

It depends.
If your organization uses Atlassian software to collect, manage, or process personally identifiable information (PII) of EU residents, then under GDPR you are likely considered a Data Controller.
We recommend reviewing the EU GDPR guidelines to understand your obligations in detail.

3. Is Agile Pulse a Data Controller or Data Processor for my Agile Pulse Server apps?

No.
Agile Pulse is neither a Data Controller nor a Data Processor for server‑based apps.

  • Server apps are downloaded and hosted on your own servers, and Agile Pulse does not have access to those servers or the data stored on them.

  • Any data you load into server apps is entirely under your control and is processed exclusively by your organization.

4. Is Agile Pulse a Data Controller or Data Processor for my Data Center apps?

No.
Agile Pulse is neither a Data Controller nor a Data Processor for Data Center apps.

  • Data Center apps are downloaded and hosted on your organization’s own servers.

  • Agile Pulse does not have access to your local servers or the data stored on them.

  • Any data you choose to load into these apps is entirely under your organization’s control and is processed solely by you.

5. Is Agile Pulse a Data Controller or Data Processor for my Cloud apps?

Agile Pulse is not a Data Controller for cloud‑based apps.

  • You, as the customer, remain in control of how your data is used and processed.

Agile Pulse does act as a Data Processor for many of our cloud‑based apps:

  • These apps operate as third‑party integrations within your Atlassian Cloud instance, where you define how your data is used through Atlassian’s interface.

  • Some cloud apps may process and temporarily store functional log data on your behalf in secure, encrypted databases, strictly for operational purposes.

6. What is a Data Processing Agreement (DPA)?

A Data Processing Agreement (DPA) is a formal agreement under GDPR between a Data Controller and a Data Processor.

  • It confirms that the Data Processor meets GDPR requirements and handles personal data in compliance with the regulation.

  • A DPA should clearly demonstrate that both parties:

    1. Are aware of and committed to GDPR compliance

    2. Will protect the personal data of customers, employees, and other applicable individuals

    3. Understand their respective roles and responsibilities for processing personal data

Agile Pulse can provide a signed DPA upon request for customers who require it to comply with GDPR.

7. When is a Data Processing Agreement required for GDPR compliance?

A DPA is required only when a Data Controller engages a third‑party service provider (Data Processor) to process personal data of EU citizens.

8. Do we need to sign a Data Processing Agreement with Agile Pulse?

You may need a DPA if your organization is a Data Controller and processes personally identifiable information (PII) of EU citizens through one of Agile Pulse’s cloud‑based applications.

9. Can Agile Pulse provide a signed Data Processing Agreement (DPA) for GDPR compliance?

Yes.
You can submit a request for a signed Agile Pulse DPA using our request form.
Please note that, due to the size of our customer base, Agile Pulse does not execute customer‑provided DPAs and only issues our standard DPA for GDPR compliance.

10. Does Agile Pulse use sub‑processors?

Yes. Like most modern software providers, Agile Pulse relies on trusted third‑party service providers to help deliver and operate our products.
